1.- Introduction

This Legal Notice regulates the terms of conditions of use of www.alsa.com/alsa-trips/alsa-viajes. The individual (hereinafter, "User") who accesses the page for information and to hire the services on offer over www.alsa.com/alsa-trips declares that the said user is of legal age (i.e. 18 or over) and has the requisite legal capacity to purchase the aforementioned services and to use them in accordance with the general terms and conditions that are set forth below, which the user declares to expressly understand and accept. If any service is hired by a minor, VIAJES ALSA shall not assume liability under any circumstance. In such a case the minor, the minor's parents or guardians shall be liable for any costs that may be incurred.

VIAJES ALSA runs the website and, particularly, offers and, where appropriate, supplies the content, products and services to the visiting www.alsa.com/alsa-trips/alsa-viajes user in the name and on behalf of transport operators. Accordingly, VIAJES ALSA limited itself to including the service on the website.

The purchase of services over the website means that the user accepts (i) these general terms and conditions, (ii) the particular terms and conditions that apply to the product/service in question that is to be hired and (iii) the product/service provider's terms and conditions, including those related to personal data protection.

4.- Purchasing Process

Before hiring the service, the user is hereby informed that the www.alsa.com/alsa-trips website has the following sections:

a) "AlsaCab" service, where the different processes are described to be followed to buy an “AlsaCab” ticket. Purchase terms and conditions are specified on www.alsa.com.

The document used to give proper form to the contract by virtue of which the customer acquires any AlsaCab service shall be sent to the user by e-mail. The aforementioned e-mail shall contain information on the service hired, its tracking number, all instructions on the method of payment, cancellation conditions, in addition to useful information and, where appropriate, the sending of travel documentation. The document shall likewise be kept on file by VIAJES ALSA.

The methods of payment are those indicated at www.alsa.com.

5.- Right of Withdrawal

This refers to the right the user has to withdraw from the contract in certain circumstances without having to substantiate any such decision or accept any penalty.

In accordance with Article 93(k) of Royal Legislative Decree 1/2007 adopting the codifying legislation of the General Consumer and User Defence Act, the remote sales regulation (except for Article 98(2) thereof) does not apply to road passenger transport contracts. Accordingly, the right to withdrawal does not apply to passenger transport service reservations. Thus, if users wish to cancel their tickets the terms and conditions in place at the transport operator company in question shall apply.

6.- Intellectual and Industrial Property Rights

The texts, images, brands, graphics, logotypes, software files, colour combinations, as well as the structure, selection, ordering and presentation of www.alsa.com/alsa-trips content belongs to VIAJES ALSA and their reproduction, distribution, public communication and transformation is strictly prohibited. Furthermore, the reproduction, transmission, copying, assignment and broadcasting, whether wholly or in part, of the information contained on these pages is also strictly prohibited, whatever the purpose be or medium used to this end.

The aforementioned content cannot be used, reproduced, distributed, modified, publicly communicated, assigned, transformed or subject to any other disseminating procedure that has not been expressly authorised beforehand in writing. VIAJES ALSA reserves the right to take any legal proceedings open to it against those who infringe upon its aforementioned owner rights.

VIAJES ALSA shall not be liable, either directly or collaterally, for any user infringement of intellectual and industrial property rights, rights to honour, personal and family privacy and one's own image (photographs), property rights and those of any other kind that pertain to third parties as a result of transmitting, disseminating, storing, making available, receiving, obtaining or accessing the content.

7.- Modifications

The portal reserves the right to modify, limit or cancel the aforementioned terms and conditions that apply to the website. Whatever the case, the terms and conditions that were in place when customers make their reservations shall apply, or any later ones should these prove more beneficial to consumer interests.

VIAJES ALSA reserves the right to refuse or withdraw access to the Portal and/or Services to those users that fail to observe these General Terms and Conditions at any given moment in time and without the need for prior warning.

8.- Applicable legislation and Jurisdiction

These terms and conditions are subject to Spanish law, and particularly, Royal Legislative Decree 1/2007 adopting the codifying legislation of the General Consumer and User Defence Act. The purchase of combined travel packages shall be subject to the purchasing terms and conditions provided for in Book IV, Title II of the aforementioned Royal Legislative Decree 1/2007. It corresponds to the courts and tribunals of Madrid to hear any case arising from these terms and conditions, notwithstanding that which is provided for in Royal Legislative Decree 1/2007 of 16 November adopting the codifying legislation of the General Consumer and User Defence Act, pursuant to which when the other party to the suit is a consumer or user it shall correspond to the courts and tribunals of the latter's jurisdiction to hear the case.
